| metadata.dc.description.resumo: | Este artigo situa-se no âmbito de teoria do direito e estuda os problemas de incompletude e incoerência no direito positivo. Parte da concepção de sistema, de larga aplicação na dogmática jurídica, e sugere os conceitos de regra e meta-regra como ferramentas para tratar o problema das antinomias dentro da teoria das lacunas e sua necessidade de integração no sistema jurídico. Na trilha de uma metodologia retórica erística, explicada ao longo do texto, oferece vários exemplos práticos esclarecedores e conclui com a análise da questão da retroatividade e seus impedimentos clássicos, construídos no Estado democrático de direito: direito adquirido, ato jurídico perfeito e coisa julgada. |
| Abstract: | This article is within the scope of legal theory and studies the problems of incompleteness and inconsistency in positive law. It starts from the concept of a system, with wide application in legal dogmatics, and suggests the concepts of rule and meta-rule as tools to deal with the problem of antinomies within the gap theory and its need for integration into the legal system. In the path of an eristic rhetorical methodology, explained throughout the text, it offers several enlightening practical examples and concludes with the analysis of the issue of retroactivity and its classic impediments, built in the democratic rule of law: acquired right, perfect legal act and res judicata. |
