O direito ao transporte como direito fundamental social: análise da construção da luta pelo transporte na Grande Vitória durante as duas primeiras décadas do Séc. XXI

Abstract

The present study seeks to present in an introductory way the social struggles by transport occurred between 2005 and 2013 in Greater Vitória, being the Free Pass Movement and the Movement Against the Increase. THE research aims to present the social achievements that were possible based on the social and political clashes between civil society and the State. what if question is whether the pressures exerted by society through demonstrations public during this period, were enough to put pressure on the executive powers, legislature and judiciary of Espírito Santo to move towards meeting the demands of these movements, through the creation, repeal and modification legislative acts, or even through actions that represent the interests of the society on transport and mobility in the Greater Metropolitan Region Victory. In short, if the State moved to mediation or repression in response to these movements and their consequences. The Transcol System and the Third Bridge toll are addressed as the main factors of discontent and motivation of the popular mobilizations that took place in that period. There is an exhibition of the June journeys across the country, which took place in the year of 2013, where soon after the PEC 74 was presented, which would become the Amendment 90 of 2015, responsible for enacting transport on the list of social rights, integrating the role of art. 6 of the Federal Constitution. Finally, they were presented the legislative changes and actions related to the theme and systematized in temporal order of events.
