A influência midiática no tribunal do júri: uma análise Bourdieusiana sobre a violência simbólica no campo da comunicação

Abstract

The present work deals with the influence exerted by the media on the verdicts of the Jury Court, especially considering that we are living “age of communication”, marked by the use of various means of communication such as television programs, newspapers, radios and the internet to disseminate information, even if untrue or uncertain. The big question is to analyze to what extent the data published in the media can influence the forensic routine, especially in the decision of the Jury Court, formed by jurors without notorious legal knowledge. It is an extremely current and relevant subject since the performance of the media of unrestrained manner can cause unwanted interference that makes it difficult to impartiality of the jury since its decisions must occur through analysis of the evidence produced by the parties during the trial and by their free conviction. To achieve this objective, we discussed the Jury Court, the its competence and composition, as well as the procedural principles that guide it, especially the principle of impartiality and the presumption of innocence, analyzing how they may be affected by media activities. The deductive methodology was adopted with the aim of giving credibility to the information through the techniques of bibliographic and documentary research. Furthermore, the present study concludes by the need for the Jury's judgment to be impartial and limited to the facts presented at a hearing, not giving space to media judgment, behold, often have no constitutional value.
