A invisibilidade da pessoa idosa e a responsabilidade civil pelo abandono afetivo inverso

Abstract

The present study deals with the analysis of civil liability for inverse affective abandonment, in order to investigate the possible legal consequences resulting from the physical or moral abandonment of children towards their elderly parents. In order to carry out this study, the inductive method of research was adopted, using the techniques of bibliographic and document review accompanied by field research, seeking, above all, to carry out work with the institutionalized elderly in the Asilo de Vitória (ES). It is intended, through this work, to demonstrate the possibility of applying the institute of civil liability in the form of imposition of compensation for moral damages in the face of violation of the duty of care existing between children and parents. As main conclusions, we highlight the use of the aforementioned institute in order to protect the legal duty of care and its use as a preventive action of an inhibitory nature to the increasingly frequent inverse affective abandonment practices, both with a view to contributing to the deinvisibility of the elderly individual.
