Organismos geneticamente modificados e organismos geneticamente editados: análise legislativa a partir do princípio da precaução

Abstract

The article analyzes the interference of Genetically Edited foods (GEO), produced using the CRISPR/Cas9 technique, in the realization of the fundamental right to health, from the perspectives of bioethics, the precautionary principle and the concept of risk society. It verifies whether the current Brazilian legislation, which regulates Genetically Modified Organisms (GMOs), is sufficient to also regulate the new Genetically Edited Organisms. In an analytical perspective of a dialectical approach and through an exploratory-descriptive study, it analyzes the differences between GMOs and GMOs, in relation to food production and the possible consequences to human health, resulting from these genetic alterations. It also investigates how the subject is treated in other countries, from a legislative perspective, for comparative purposes with the current Brazilian legislation. The verification of the existence of uncertainties, of the most diverse, on the GMOs, points to the need to deepen its scientific investigation, for the legislative improvement that contemplates the differences between GMOs and GMOs, as well as for the matter to be properly publicized, with a view to to the establishment of an adequate regulation system compatible with its specificities.
