A ação civil pública e a proteção dos direitos fundamentais no combate ao trabalho escravo

Abstract

The purpose of this work is to discuss over the human rights, concerning slave-like work, access to justice and class action lawsuit. The issue to be discussed is in what ways the class action lawsuit can be an essential instrument for the consolidation of human rights in the struggle against slave-like work. In order to develop the research, the multi-disciplinary dialectic approach was used, so that it would allow different focuses within the same subject. The sources that were used in the writing of this work were: bibliographical and documental research as well as analytical reading of articles, books, legislation and analysis of related court decisions.The results reached on the research show that the class action lawsuit along with the creativity of the magistrates and labor attorneys are able to guarantee – in order to defend the human rights - actual punishment to those who still keep human beings as slaves. Using the results obtained from this action, it is possible to provide dignity of the human being and the citizenship, not only for workers that were rescued from the bondage, but also the nearby communities. As the provision under jurisdiction punishes those who are charged with the crime as read on art. 149, CPB, the effective access to justice is promoted.
