Guarda de menores e o patriarcado (des)velado a partir da pandemia de Covid-19

Abstract

This work investigates the maintenance of patriarchal logic in the configuration of the guard of minors, in the reality of Brazilian families, from the Covid-19 pandemic. Although the Brazilian legal system indicates a preference for custody shared, patriarchy is still present, through the incumbent of domestic work and family care for women. The pandemic interfered about this scenario, since social isolation prevented the sharing of guard, in the physical sense. Therefore, this research questions the permanence of the structure of patriarchy in determining the family configuration, with regard to custody and coexistence with minors during the pandemic. For this, it adopts dialectical method, with bibliographic research and analysis of media reports and court decisions. In the first topic, it analyzes the influence of patriarchy on the Brazilian family structure. In the second topic, it discusses the benefits and objectives of shared custody. The third topic analyzes the particularities of the custody of minors and coexistence with their parents from the pandemic. Thus, it identifies maintenance of the patriarchal logic, noting that, nowadays, it is still assign to women the activities of domestic care, so that, normally, the children remain with them, even in cases of custody shared. Therefore, it concludes that the pandemic opened up the influence of the patriarchy in current Brazilian society, which still naturalizes motherhood as a responsibility for the care of children
