metadata.dc.description.resumo: | Este trabalho investiga a manutenção da lógica patriarcal na configuração da guarda de menores, na realidade das famílias brasileiras, a partir da pandemia de Covid-19. Embora o ordenamento jurídico brasileiro indique uma preferência pela guarda compartilhada, o patriarcado ainda se mostra presente, por meio da incumbência dos trabalhos domésticos e do cuidado da família às mulheres. A pandemia interferiu sobre esse cenário, uma vez que o isolamento social obstou o compartilhamento da guarda, no sentido físico. Diante disso, esta pesquisa questiona a permanência da estrutura do patriarcado na determinação da configuração familiar, no que se refere à guarda e à convivência com os menores, durante a pandemia. Para isso, adota o método dialético, com pesquisa bibliográfica e análise de relatos midiáticos e decisões judiciais. No primeiro tópico, analisa a influência do patriarcado sobre a estrutura familiar brasileira. No segundo tópico, discute os benefícios e objetivos da guarda compartilhada. O terceiro tópico analisa as particularidades da guarda de menores e da convivência com os genitores a partir da pandemia. Assim, identifica a manutenção da lógica patriarcal, ao constatar que, nos dias de hoje, ainda se atribuem às mulheres as atividades de cuidado doméstico, de modo que, normalmente, os filhos permanecem com elas, mesmo nos casos de guarda compartilhada. Portanto, conclui que a pandemia escancarou a influência do patriarcado na sociedade brasileira atual, que ainda naturaliza a maternidade como responsabilidade pelo cuidado dos filhos |
Abstract: | This work investigates the maintenance of patriarchal logic in the configuration of the guard of minors, in the reality of Brazilian families, from the Covid-19 pandemic. Although the Brazilian legal system indicates a preference for custody shared, patriarchy is still present, through the incumbent of domestic work and family care for women. The pandemic interfered about this scenario, since social isolation prevented the sharing of guard, in the physical sense. Therefore, this research questions the permanence of the structure of patriarchy in determining the family configuration, with regard to custody and coexistence with minors during the pandemic. For this, it adopts dialectical method, with bibliographic research and analysis of media reports and court decisions. In the first topic, it analyzes the influence of patriarchy on the Brazilian family structure. In the second topic, it discusses the benefits and objectives of shared custody. The third topic analyzes the particularities of the custody of minors and coexistence with their parents from the pandemic. Thus, it identifies maintenance of the patriarchal logic, noting that, nowadays, it is still assign to women the activities of domestic care, so that, normally, the children remain with them, even in cases of custody shared. Therefore, it concludes that the pandemic opened up the influence of the patriarchy in current Brazilian society, which still naturalizes motherhood as a responsibility for the care of children |
