dc.description.abstractThe present work analyzed the legal nature of the relationship between the driver and Uber Technologies (Uber), a North American transnational company whose main activity is the provision of private transport services. Based on this relationship, the presence of the constitutive elements of the employment relationship found in articles 2 and 3 of the Consolidation of Labor Laws were analyzed: habituality or non-event, subordination, personality and onerosity. In addition, Uber's business model was examined, with the aim of observing whether the company acts as a mere intermediary between driver and passenger or if there is an action of employer power, through the direction, inspection and punishment of conduct carried out by drivers. in the work routine. Despite the international trend of recognizing the employment relationship or at least recognizing some labor rights to these drivers, the reiterated understanding of the Superior Labor Court is that the aforementioned worker is self-employed. From the analysis carried out, as well as the legal framework of the relationship between driver and Uber in the necessary legal requirements to characterize the employment relationship, it was concluded that the non-recognition of the employment relationship by Uber's business model violates labor standards, in addition to validating the precariousness of work and the disproportionate burden on the driver partnerpt_BR
dc.description.resumoO presente trabalho analisou a natureza jurídica da relação entre o motorista e a Uber Tecnologies (Uber), transnacional norte-americana que possui como atividade principal a prestação de serviços de transporte particular. Foram analisados, a partir dessa relação, a presença dos elementos constitutivos da relação de emprego encontrados nos artigos 2º e 3º da Consolidação das Leis Trabalhistas: habitualidade ou não eventualidade, subordinação, pessoalidade e onerosidade. Além disso, examinou-se o modelo de negócio da Uber, com o escopo de observar se a empresa atua como mera intermediadora entre motorista e passageiro ou se há atuação de poder patronal, por meio da direção, fiscalização e punição das condutas realizadas pelos motoristas na rotina de trabalho. Apesar da tendência internacional de reconhecimento do vínculo empregatício ou pelo menos de se reconhecer alguns direitos trabalhistas a esses motoristas, o entendimento reiterado do Tribunal Superior do Trabalho é de que o aludido trabalhador é autônomo. A partir da análise realizada, bem como do enquadramento jurídico da relação entre motorista e Uber nos requisitos legais necessários para caracterização do vínculo empregatício, concluiu-se que o não reconhecimento do vínculo empregatício por parte do modelo de negócio da Uber viola normas trabalhista, além de validar a precarização do trabalho e o ônus desproporcional ao motorista parceiropt_BR
