| metadata.dc.description.resumo: | O presente estudo visa analisar a eficácia das normas de soft law no que tange a questão migratória, de modo a compreender se esse tipo de norma tem obtido êxito no sentido de garantir os direitos humanos dos indivíduos migrantes e refugiados, especialmente. Para tanto, será analisado o histórico recente no que tange a questão migratória em si, analisando fluxos migratórios mais recorrentes e as características de cada tipo de migração. Ademais, será analisada friamente o fenômeno da soft law, seu surgimento, conceito e quais são seus principais exemplos, de modo a expor os efeitos práticos desse tipo de norma no campo do Direito internacional. Por fim, busca se um parecer acerca dessa eficácia ou ineficácia, de modo que tal conclusão propulsione novos debates e novas propostas para lidar com a problemática, se necessário for |
| Abstract: | The present study aims to analyze the effectiveness of soft law norms regarding the migration issue, in order to understand if this type of rule has been successfulin order to guarantee the human rights of migrants and refugees,especially. In order to do so, the recent history regarding the issue will be analyzed.migration itself, analyzing the most recurrent migratory flows and the characteristics of each type of migration. In addition, the phenomenon of soft law will be analyzed coldly, its emergence, concept and what are its main examples, in order to expose the practical effects of this type of rule in the field of international law. Finally, an opinion is sought about this effectiveness or ineffectiveness, so that such a conclusion promote new debates and new proposals to deal with the problem, if necessary is |
