metadata.dc.description.resumo: | O presente trabalho intenciona realizar um estudo acerca do ensino domiciliar, reconhecido internacionalmente pelo termo homeschooling, e seu possível reconhecimento legal no Ordenamento Jurídico Pátrio. Para que seja atingido o principal objetivo, será feita uma investigação a respeito da educação no Brasil a partir da Constituição Federal de 1988 e uma breve análise do tratamento que ela recebeu na atual legislação infraordinária, bem como examinar-se-á a natureza de direito social inerente à educação. Importante ressaltar que serão expostas as conceituação dos termos ensino escolar e ensino doméstico, além da realização de um apurado a respeito dos pontos positivos e negativos do método de ensino homeschooling. Por fim, serão enfrentados os principais argumentos utilizados na decisão em sede de Recurso Extraordinário nº 888.815/RS, a qual decidiu pela constitucionalidade doensino em casa, sendo estes a liberdade de escolha dos pais, a socialização do indivíduo e o pluralismo de ensino. Além disso, o presente estudo tem como objetivos ressaltar a importância do direito à educação no Estado Democrático de Direito, expor a modalidade do ensino domiciliar e questionar a constitucionalidade do referido método de ensino proferida pela Suprema Corte |
Abstract: | The present work intends to carry out a study on homeschooling, internationally recognized by the term homeschooling, and its possible legal recognition in the National Legal Order. In order to reach the main objective, an investigation will be made about education in Brazil from the Federal Constitution of 1988 and a brief analysis of the treatment it received in the current infraordinary legislation, as well as the nature of right inherent to education. It is important to emphasize that the concepts of the terms of school education and home education, in addition to carrying out an investigation into the positive and negative aspects of the homeschooling teaching method. Finally, the main arguments used in the decision in the Extraordinary Appeal nº 888.815/RS will be faced, which decided for the constitutionality of homeschooling, which are the freedom of choice of parents, the socialization of the individual and the pluralism of teaching. In addition, the present study aims to emphasize the importance of the right to education in the Democratic State of Law, to expose the modality of home education and question the constitutionality of the referred teaching method handed down by the Supreme Court |
