dc.description.abstract | The present work analyses the institute known as amicus curiae and its origin, historical evolution in the judicial system in Brazil and its judicial nature. We approach its participation in the brazillian judicial order as it relates to the institute of democracy and and its new form of applicability and form of presentation in the new code of civil procedures. Finally, we discuss the theme of forms of actions and possible conduct in legal proceedings on repetitive cases to the point of exhaustion of the legal system in Brazil; how the institute may take action, and in what moments of the legal procedure there may be limitations and how the amicus curiae may appeal – which is new in the reformed code. dc.description.resumo | O presente trabalho se propõe analisar o instituto do amicus curiae a respeito de sua origem, sua evolução histórica no sistema jurídica brasileiro e sua natureza jurídica. Abordamos sua participação no ordenamento brasileiro no que diz respeito à democracia e sua nova forma de aplicação e apresentação no código de processo civil/2015. Finalmente, abordamos a temática da atuação do instituto em questão, o amicus curiae, no Incidente de Resolução de Demandas Repetitivas e como pode atuar, em que momentos do processo encontra seus limites e como se dá a questão do recurso em IRDR, questão nova do CPC/15.
