| metadata.dc.description.resumo: | O presente trabalho irá realizar uma análise do lawfare sob múltiplas óticas, responderá questionamentos que vão desde se de fato o lawfare existe enquanto conceito e prática, e até as características mais comuns e teorias e disciplinas das ciências sociais relevantes para a elucidação de seus sentidos e bases. Em primeiro lugar se desenvolverá o contexto histórico do lawfare e seu papel no pensamento militar moderno. Prosseguirá a examinar a diversidade conceitual com vistas a enriquecer o objeto de estudo, o lawfare, com novas determinações. Por fim, serão mapeados os mecanismos discursivos e práticos sob os quais o lawfare operam, tanto em aspectos gerais e históricos, como em aspectos técnicos e processuais. Por fim, se defenderá uma abordagem de estudo do lawfare e abrirá questionamento a respeito da necessidade de imbuir o direito do pensamento militar como forma de obter um nível de previsibilidade sobre como, quando e onde novos conflitos militares da geopolítica irão surgir no direito |
| Abstract: | The present work will carry out an analysis of lawfare from multiple perspectives, it will answer questions ranging from whether lawfare actually exists as a concept and practice, and even the most common features and theories and disciplines of the social sciences relevant to the elucidation of its senses and bases. First, the historical context will be developed. of lawfare and its role in modern military thought. Will continue to examine diversity conceptual in order to enrich the object of study, the lawfare, with new determinations. Finally, the discursive and practical mechanisms under which lawfare operate will be mapped, both in general and historical aspects, as in technical and procedural aspects. Finally, if will advocate an approach to the study of lawfare and open up questions regarding the need to imbue the right of military thinking as a way to obtain a level of predictability of how, when and where new geopolitical military conflicts will emerge on the right |
