A judicialização contra jornalistas por transmitirem suas opiniões políticas: seria uma nova forma de censura contemporânea?

Abstract

This study aims to verify the possibility or impossibility of new forms of censorship in the current Brazilian political scenario are happening and if judicialization may be collaborating to the practice of censorship. It is known that censorship has been practiced for a long time in the world society, being present since the feudal period.However, new forms of censorship are little discussed, and it is not possible to realize whether it would be possible to guarantee the prevalence of Fundamental Rights, namely, freedom of speech, freedom of information and freedom of the press, only with the constitutional text blocking censorship. In these terms, this study is relevant. Initially, the origin and concept of censorship is studied, as well as how this act was present in ancient societies and how censorship had effects resulting from the suppression of rights in society. Subsequently, an analysis is made of the practice of censorship in Brazil and how the constitutional text prohibits such act, differentiating between later and earlier censorship. Next, the concept of freedom of speech, freedom of information, freedom of the press and their limits is explained. Finally, it is presented how the rights mentioned above are important for the career of journalism, in which, later, a comparative law with other countries will be performed, also demonstrating the duties and responsibilities that journalists must have when disseminating their news and opinions. At the end of this study, it is intended to demonstrate if there are new forms of censorship that affect Brazilian society, and if the practice of Lawfare is occurring in Brazil
