| metadata.dc.description.resumo: | O presente trabalho busca entender a influência do patriarcado no processo de criação das leis trabalhistas brasileiras, em especial o auxílio creche. Para entender como o patriarcado atua sobre essas leis, foi analisado o trâmite processual de criação de leis e constatado que o gênero masculino tem papel principal para essa influência. O trabalho tem como objetivo principal a constatação do conteúdo patriarcal da lei de auxílio creche, como isso ocorreu e qual é a melhor forma de modificar essa situação. O método utilizado foi o dialético, visto que o principal interesse com a obra é a quebra de paradigma desse costume, trazendo melhores condições para as mulheres. Assim, foram examinados livros, doutrinas, jurisprudências, legislações, dados estatísticos, etc. para uma melhor compreensão e argumentação. Os resultados foram positivos, visto que foi constatada a baixa representatividade feminina na política contrária a alta representatividade masculina e por isso a relação desse último com a influência do patriarcado nas leis, visto que os homens são mais de 80% do Congresso Nacional, órgão de criação das leis e esse valor se repete quando é considerado as esferas estaduais e municipais |
| Abstract: | The present work seeks to understand the influence of patriarchy in the process of creation of Brazilian labor laws, in particular daycare assistance. To understand as the patriarchy acts on these laws, the procedural process of creation of laws and found that the male gender has a main role in this influence. The work has as its main objective the verification of the content patriarchal daycare assistance law, how did this occur and what is the best way to modify this situation. The method used was dialectical, since the main interest in the work is the breaking of the paradigm of this custom, bringing better conditions for women. Thus, books, doctrines, jurisprudence, legislation, statistical data, etc. for a better understanding and argumentation. The results were positive, as the low female representation in politics contrary to high male representation and therefore the relationship of the latter with the influence of patriarchy in the laws, since men make up more than 80% of the National Congress, the body that creates laws and this value is repeated when considering the state and municipal spheres |
