Title: Transferência dos custos ao trabalhador no teletrabalho: uma análise à luz do princípio da alteridade

metadata.dc.description.resumo: No presente trabalho, pretendeu-se analisar, sob o enfoque do princípio da alteridade, o tema da transferência dos custos do teletrabalho para o teletrabalhador. Assim, relacionado ao tema, o artigo 75-D da Consolidação das Leis do Trabalho - CLT apresenta-se como resultado da regulamentação do teletrabalho operada por meio da Lei 13.467/2017, a Reforma Trabalhista, e trata da responsabilidade pelas despesas realizadas para a execução do teletrabalho, assim como trata do ressarcimento do teletrabalhador que vier a suportá-las. No entanto, o mencionado artigo não indica se as referidas despesas cabem ao empregador ou ao teletrabalhador, abrindo margem para a possibilidade de que essas sejam transferidas para este. Essa situação levanta, desse modo, o questionamento sobre se o artigo 75-D encontra-se em conformidade com o princípio da alteridade o que, compreende-se, apresenta-se relevante para os sujeitos da relação trabalhista e para os profissionais do Direito. Assim sendo, para investigação desse problema, buscou-se analisar o disposto no artigo 75-D da CLTadotando-se, como parâmetro, o princípio da alteridade. Para esse propósito, intentou-se investigar o teletrabalho como tendência na atual revolução tecnológica, detalhando o conceito normativo de teletrabalho e abordando alguns dos principais aspectos da presente fase da tecnologia. Na sequência, visou-se assinalar a regulamentação do teletrabalho operada pela Lei 13.467/2017, desenvolvendo a discussão entre posicionamentos acerca da Reforma Trabalhista e examinando os dispositivos relativos à matéria do teletrabalho. Posteriormente, buscou-se traçar considerações gerais acerca da alteridade, realizando um levantamento sobre os significados desse termo para algumas áreas do conhecimento, sobretudo, para a do Direito do Trabalho. Em seguida, pretendeu-se analisar o artigo 75-D da CLT de acordo com o princípio da alteridade, abordando a definição do referido princípio e as funções dos princípios, bem como apresentando e discutindo as principais críticas e observações sobre o artigo 75-D. Por último, intentou-se investigar a jurisdição exercida pela Justiça do Trabalho quanto à responsabilidade pelas despesas com o teletrabalho, procedendo a apresentação de alguns julgados e as observações sobre esses. Para tanto, quanto à metodologia, utilizou-se o método hipotético-dedutivo, realizando uma abordagem qualitativa, de objetivo descritivo, a partir dos procedimentos de pesquisa bibliográfica e pesquisa documental. Por conseguinte, verificou-se, principalmente, que o artigo 75-D da CLT não se encontra em conformidade com o princípio da alteridade. Ainda, compreendeu-se que o teletrabalho apresenta-se como uma tendência na atual revolução tecnológica. Ademais, verificou-se que a Reforma Trabalhista configura-se em afronta ao propósito civilizatório do Direito e, em especial, aos princípios conformadores do Direito do Trabalho, sendo que, além do referido artigo 75-D, outros dispositivos relativos à matéria do teletrabalho propiciam interpretação e práticas danosas ao teletrabalhador. Além disso, percebeu-se que não há, ainda, uma jurisprudência relativa, especificamente, ao artigo 75-D da CLT
Abstract: In the present work, it was intended to analyze, under the perspective of the alterity principle, the theme of transferring costs from telework to teleworker. Thus, related to the topic, article 75-D of the Consolidation of Labor Laws - CLT presents itself as a result of the regulation of telework operated through the Law 13,467/2017, the Labor Reform, and deals with the responsibility for expenses carried out for the execution of telework, as well as the reimbursement of teleworker who will support them. However, the forementioned article does not indicate whether these expenses are the responsibility of the employer or the teleworker, making room for the possibility that these are transferred to this one. This situation raises, thus, the question whether Article 75-D is in compliance with the principle of alterity, which, it is understood, is relevant to the subjects of the labor relationship and for legal professionals. Therefore, to investigation of this problem, we sought to analyze the provisions of article 75-D of the CLT adopting, as a parameter, the principle of alterity. For this purpose, an attempt was made to investigate telework as a trend in the current technological revolution, detailing the normative concept of telework and addressing some of the main aspects of the present phase of the technology. Next, the aim was to mark the regulation of telework operated by Law 13,467/2017, developing the discussion between positions on the Labor Reform and examining the devices relating to the matter of telework. Subsequently, we sought to trace general considerations about alterity, carrying out a survey on the meanings of this term for some areas of knowledge, especially for the Labor Law. Then, it was intended to analyze article 75-D of the CLT of according to the principle of alterity, addressing the definition of said principle and the functions of the principles, as well as presenting and discussing the main criticisms and remarks on article 75-D. Finally, an attempt was made to investigate the jurisdiction exercised by the Labor Court as to responsibility for expenses with the telework, proceeding with the presentation of some judgments and the observations on Those. For that, as for the methodology, the hypothetical-deductive method was used, performing a qualitative approach, with a descriptive objective, from the bibliographic research procedures and documental research. Therefore, it was found, mainly, that article 75-D of the CLT is not found in accordance with the principle of alterity. Still, it was understood that the telework presents itself as a trend in the current technological revolution. Furthermore, it was found that the Labor Reform constitutes an affront to the purpose Civilization of Law and, in particular, to the conforming principles of the Law of the Work, and, in addition to the aforementioned article 75-D, other provisions relating to matters of telework provide harmful interpretation and practices to the teleworker. In addition, it was noticed that there is still no relative jurisprudence, specifically, to article 75-D of the CLT
