| Abstract: | Starting from the tripartite perspective rhetoric as material, practical and analytical, suggested by Ottmar Ballweg, the author seeks to add another tripartite and establish their correspondence. The additived categories correspond to method, methodology, and methodical. With that premise, addresses specific issues of law, noting, among other things the impossibility of a dogmatic analytical, also addresses the analytical rhetorical and the science of law, describing the juridical dogmatic as a method and methodology, and finally presents the postulates of the functional dogmatic, and move the text to the norm |
