| metadata.dc.description.resumo: | Como vou defender que a retórica é uma atitude filosófica, começo por dizer que a tarefa da filosofia do direito pode ser reduzida a dois grandes campos de investigação. Por um lado ela procura saber o que é o direito, como ele pode ser descoberto, conhecido, consultado. Por exemplo: o direito vem objetivamente da lei ou vem do que os juízes decidem que a lei quer dizer? E quando a sociedade não obedece à lei, por vezes até órgãos do próprio Estado não seguem a lei, o direito é o que a lei diz ou o que seus destinatários efetivamente fazem? Este é o problema do conhecimento do direito, o problema da norma jurídica |
| Abstract: | As I will argue that rhetoric is a philosophical attitude, I begin by saying that the task of the philosophy of law can be reduced to two major fields of investigation. On the one hand, it seeks to know what law is, how it can be discovered, known, consulted. For example: the law objectively comes from law or does it come from what the judges decide the law means? And when society does not obey the law, sometimes even state bodies do not follow the law, is the law what the law says or what its recipients actually do? This is the problem of knowledge of the law, the problem of the legal norm |
