Paradigma como conceito retórico e seu uso nas ciências jurídicas

Abstract

This article intends to analyze the concept of paradigm in Thomas S. Kuhn's theory and demonstrate that the paradigmatic thinking, which so influenced academia and science in the 20th century, is part of a rhetorical philosophy, and not ontological. Despite not having coined the term, it was with Kuhn that “paradigm” took the direction of scientific thought guidelines, which sought to solve problems based on a community of practitioners of a science. The validation of knowledge by the community gives the paradigm a rhetorical character, seeking the winning report through argumentation. Rhetoric brings rationality when certainty is not possible. Unlike an ontological conception, rhetoric, like paradigms, builds its conviction. It can then be maintained that science is constituted rhetorically
