| metadata.dc.description.resumo: | O autor, aproveitando a sua dupla dimensão, de prático e académico do direito, ao longo do artigo, desenvolve o tema da tutela jurídica dos direitos humanos ao longo da história mais recente na República Federativa do Brasil, em particular sob a égide da Constituição Federal de 1988, Assume o desafio de transmitir ao leitor uma visão geral, adotando como metodologia a descrição do quadro normativo interno e a dinâmica que se estabelece entre a legislação e a jurisdição interna, e entre esta e os mecanismos regionais de proteção aos direitos humanos. Aborda também a dicotomia que deverá existir entre a concretização de Direitos Humanos e a intervenção social do Estado, no binómio direitos humanos e segurança e interesse públicos. |
| Abstract: | The author, taking advantage of its double dimension, of practical and academic law, throughout of the article, develops the theme of legal protection of human rights throughout history more in the Federative Republic of Brazil, in particular under the aegis of the Federal Constitution of 1988, Assumes the challenge of transmitting to the reader an overview, adopting as methodology the description of the internal regulatory framework and the dynamics established between legislation and domestic jurisdiction, and between this and regional human rights protection mechanisms. It also addresses the dichotomy that must exist between the realization of Human Rights and the State social intervention, in the binomial human rights and public security and interest. |
