metadata.dc.description.resumo: | O presente trabalho busca investigar as principais correntes do debate contemporâneo acerca da legitimidade da interpretação constitucional. Em outras palavras, o estudo repousa na necessidade de se investigar os diversos argumentos que embasam e endossam a atuação das principais instituições políticas, com o recorte sobre o arcabouço teórico que repousa sobre o Judiciário e sobre o Legislativo. Para tanto, o estudo é calcado no método dialético. Primeiramente será feita uma abordagem dos fundamentos justifi cadores da supremacia judicial (tese). Em seguida, a abordagem recairá sobre os fundamentos da supremacia legislativa (antítese), com especial atenção para os argumentos que rechaçam a supremacia judicial. Por fi m, serão evidenciados os argumentos que rejeitam qualquer tipo de supremacia (síntese), argumentos categorizados sob a alcunha de “Promessa Dialógica”, a representar uma espécie de terceira via entre as duas outras correntes. Investigado todo esse arcabouço teórico, será possível visualizar a sofi sticação que existe nesse debate, bem como se o desempenho das instituições está alinhado com sua legitimação. |
Resumen : | The following paper investigates the main ideas over the contemporaneous debate about the constitutional interpretation legitimacy. In other words, this study is based on the necessity to investigate several topics that build major political institutions, especially the theoretical framework that underlies over the Judiciary and the Legislative Branches. This study is set in the dialectical method: fi rst, we will analyze the foundations that support the judicial supremacy (thesis) and then, analyze the foundations that support the legislative supremacy (antithesis), with special attention to the topics that are against the judicial supremacy. Finally, we will point the issues that reject any kind of supremacy (synthesis). These topics are known as “Dialogical Promise” and they represent a type of third alternative between the other two main ideas. By investigating this theory, we will be able to see the sophistication that there is in this debate as well as if the performance of the institutions is aligned with its legitimacy |
