dc.description.abstractThe present work aims to draw a comparison between the theoretical propositions of Carl Schmitt and Hans Kelsen with regard to the guard of the Constitution, as well as to investigate the way in which the Brazilian Federal Constitution manifests itself on the issue and the position of the Supreme Federal Court of Brazil. Therefore, the first step is to briefly report the theory of the German jusphilosopher Carl Schmitt about the guard of the Constitution, that is, who / which institution will be assigned to the function of safeguarding the Constitution, being, in his view, the head of the Constitution. executive as indicated. Therefore, it is also necessary to make an analysis of what Hans Kelsen exposes in relation to the same theme, considering that it indicates, in a synthetic way, that the recommended is the Constitutional Court. In a third step, to verify the Brazilian constitutional perspective regarding the custody of the Constitution. Thus, finally, obtaining the relationship between the perspectives of the theses of the authors mentioned in comparison to that proposed in the Brazilian legal systempt_BR
dc.description.resumoO presente trabalho tem como objetivo traçar uma comparação entre as proposições teóricas de Carl Schmitt e Hans Kelsen no que diz respeito ao guarda da Constituição, bem como averiguar o modo como a Constituição Federal brasileira se manifesta acerca da questão e o posicionamento do Supremo Tribunal Federal do Brasil. Assim sendo, tem-se como primeiro passo relatar de maneira breve a teoria do jusfilósofo alemão Carl Schmitt acerca do guarda da Constituição, isto é, quem/qual instituição será destinada para a função de resguardar a Constituição, sendo na sua visão o chefe do executivo o indicado para tal. Diante disso, cabe também fazer uma análise sobre o que Hans Kelsen expõe em relação à mesma temática, tendo em vista que este indica, de maneira sintética, que o recomendado é o Tribunal Constitucional. Em um terceiro momento, verificar a perspectiva constitucional brasileira acerca do guarda da Constituição. Assim, finalmente, obtendo-se a relação entre as perspectivas das teses dos autores mencionados em comparação ao proposto no ordenamento jurídico brasileiropt_BR
