| metadata.dc.description.resumo: | O ideal de um constitucionalismo dirigente consiste numa construção interpretativa, que teve como principal base normativa o texto da Constituição portuguesa de 1976, elaborada por Canotilho (2001, p. 487) que, por sua vez, defende, em síntese, a superação da noção da existência de normas meramente programáticas advindas do texto constitucional, pregando a importância dos princípios e da materialidade da Constituição. Transportando para a realidade periférica brasileira, alguns autores, como Streck (2004a), por exemplo, sugerem a sedimentação, no campo jurídico, de um “constitucionalismo dirigente adequado a países de modernidade tardia”: como tentativa de defesa diante dos devastadores “ataques neoliberais” ao Estado brasileiro e de luta pela proteção dos direitos fundamentais – previstos na Constituição Federal de 1988 e nos tratados internacionais de direitos humanos ratificados pelo Brasil – e pela contínua construção da democracia. |
| Abstract: | The ideal of a leading constitutionalism consists of an interpretative construction, which had as main normative basis the text of the Portuguese Constitution of 1976, elaborated by Canotilho (2001, p. 487) which, in turn, defends, in synthesis, the overcoming of the notion the existence of purely programmatic norms arising from the constitutional text, preaching the importance of the principles and materiality of the Constitution. Transporting to the Brazilian peripheral reality, some authors, such as Streck (2004a), for example, suggest the sedimentation, in the legal field, of a “leading constitutionalism suited to countries of late modernity”: as an attempt to defend against the devastating “neoliberal attacks ”To the Brazilian State and to fight for the protection of fundamental rights - provided for in the Federal Constitution of 1988 and in the international human rights treaties ratified by Brazil - and for the continuous construction of democracy. |
